Local Fair Housing Laws: Use of eviction reports
Note: If you wish to file a complaint regarding fair housing violations, refer to the U.S. Department of Housing and Urban Development's online complaint page for more information.
In the past few years, urban city councils across the U.S. have created laws defining new protections around how housing providers select renters.
Across New York State, laws prohibit property owners and managers from using any past or current eviction actions as part of the evaluation of a rental application. Learn more about this law: https://www.nysenate.gov/legislation/laws/RPP/227-F
What does this mean for you?
In accordance with the law, Apartments.com does not run eviction reports for applicants to properties in New York State. Property owners and managers will be informed of the local law that explains the omission of this data for all applicants.
If I apply to another property outside of New York, will eviction reports be included?
Apartments.com allows applicants to re-share their rental applications to new properties. If you submit an application to a property in a jurisdiction where housing providers are allowed to consider eviction report information, Apartments.com will return an eviction report for that property's application.
